Your Neighbor Put a Shed Right Beside Your Fence. Here’s the Rule That Matters

A new shed beside your garden fence can look too close for comfort, but the distance from the boundary does not tell you on its own whether the structure breaks planning rules.

For homes in England, many sheds fall under permitted development, which means the owner may not need to apply for planning permission. One condition becomes important when the shed sits close to the property boundary: its height.

A Shed Within Two Meters of the Boundary Has a 2.5-Meter Height Limit

Under guidance from the Planning Portal, an outbuilding within two meters of a property boundary must not exceed 2.5 meters in height if it is to qualify as permitted development.

That means a shed can sit less than two meters from the fence without the position itself creating a planning violation. The 2.5-meter height limit is the key measurement in this situation.

The rule covers outbuildings such as sheds, garages, greenhouses, and summerhouses used for purposes connected with the home. A structure used as separate living accommodation falls outside that basic definition.

Being Close to the Fence Does Not Mean It Is on Your Land

Planning rules and property boundaries are two different issues. A shed could meet permitted development requirements but still create a dispute if part of it crosses the legal boundary.

The fence itself does not always prove the exact boundary position. HM Land Registry title plans show the general location of property boundaries, but they do not tend to establish the precise legal line.

If the concern is that the shed, foundations, roof, or another part of the structure extends onto your property, the question is no longer just about shed height.

Some Homes Have Different Restrictions

Permitted development rules do not apply in the same way to every property. Listed buildings and homes in some designated areas can face extra restrictions, and local conditions can affect what an owner can build without an application.

The Planning Portal guidance cited here applies to houses in England. Rules can differ in Wales, so homeowners should check with the local planning authority rather than use the 2.5-meter rule as a universal standard.

Check the Height Before Assuming the Shed Is Too Close

If a neighbor builds a shed beside your fence, start with two measurements: how far the structure sits from the property boundary and how tall it is.

When the distance is under two meters, 2.5 meters becomes the key height threshold for permitted development in England. If the issue concerns the location of the boundary itself, planning rules will not settle that question.

Boundary disputes can require title documents and other evidence, and a chartered surveyor can help establish the position of the boundary when it cannot be agreed between neighbors.
